These Terms & Conditions govern your access to and use of the Mod91 mobile applications, dashboards, and related services offered by Synergistic Financial Networks Pvt. Ltd. ("Mosambee").
By downloading or using the app you agree to be bound by these Terms, our Privacy Policy, and any supplementary program rules. If you disagree, do not install or discontinue using the services.
Eligibility, Use & Obligations
Your responsibilities when using Mod91
Eligibility & Account
- You must be legally capable of entering into binding contracts under Indian law and, when onboarding as a business, be duly authorized to bind your entity.
- You agree to provide accurate, current, and complete information during registration and whenever we request updated KYC, tax, or compliance documentation.
- You are responsible for safeguarding credentials, biometric prompts, PINs, tokens, and any device that runs the Mod91 application.
Use of Services
- Mod91 provides Mosambee POS, QR acceptance, settlement, analytics, inventory, campaign, and ancillary tools. Features may vary by device, territory, or merchant program.
- Offline or background actions (for example, WorkManager reconciliations, pending settlements, or push notifications) may continue even when the app is minimized.
- We may log, monitor, or suspend flows to protect the platform, comply with law, or investigate fraudulent activity.
Merchant Responsibilities
- Collect and pay all applicable taxes, duties, or statutory levies tied to your transactions.
- Honor consumer protection norms, RBI/NPCI operating guidelines, and any additional conditions shared by Mosambee or our banking partners.
- Promptly notify us of security incidents, suspected fraud, or unauthorized use of your devices or credentials.
Restrictions
- You must not reverse engineer, copy, resell, or otherwise misuse the Mod91 apps, SDKs, or documentation.
- You must not use the services for illegal, infringing, or harmful purposes, including the sale of restricted products, money laundering, or terror financing.
- You must not attempt to bypass security features (including RootBeer detections, Play Integrity, or biometric prompts) or overload infrastructure through automated scripts.
Fees, Settlements & Chargebacks
Understanding our payment and fee structure
Transactions, MDR, convenience charges, rental plans, and subscription fees are disclosed during onboarding or via subsequent price notices.
Mod91 may debit amounts owed (including chargebacks, returns, retrievals, penalties, taxes, or adjustments) from your settlements or the funding account you designate.
You authorize Mosambee, our banking partners, and payment networks to hold, delay, or reverse settlements when required by law or risk policies.
You remain responsible for any deficit if adjustments exceed available settlements. We may seek recovery through additional debits or other lawful means.

Intellectual Property
All trademarks, service marks, logos, design assets, code, and documentation associated with Mosambee or Mod91 remain our exclusive property. No license is granted other than the limited right to use the app as described in these terms.
Data & Privacy
Use of the services is also governed by the Mod91 Privacy Policy, which explains how we collect, use, and share information. Continued use confirms your acceptance of both documents.

To the maximum extent permitted by law, the services are provided on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, whether express, implied, or statutory.
Limitation of Liability
Mosambee, Mod91, and our affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from your use of the services.
Indemnity
You agree to indemnify, defend, and hold harmless Mosambee, Mod91, our partners, and employees against claims arising from your use of the services, violation of these terms, or infringement of third-party rights.
Termination
We may suspend or terminate access at any time for suspected fraud, security risk, non-compliance, or inactivity. You may stop using the app and request closure subject to outstanding obligations.
Governing Law & Dispute Resolution
These terms are governed by the laws of India. Courts and tribunals in Mumbai have exclusive jurisdiction, subject to any dispute resolution framework agreed between you and Mosambee.
Changes to Terms
We may update these terms to reflect product, regulatory, or business changes. We will notify you through in-app messages, email, or our website when material updates occur. Continued use after the effective date constitutes acceptance.
